H-1B Visas are used for foreign professionals within a specialty occupation who are sponsored by a U.S. employer to work in the states. 

  • Skilled worker in fields that usually require a bachelor’s degree or higher, or the equivalent. 
  • U.S. employer must prove a need for the specialized role with a valid job offer 
  • The worker is being paid the prevailing wage with form ETA form 9035. 
  • As an H-1B specialty occupation worker, you may generally be admitted for a period of up to 3 years. This initial period of admission may generally be extended for an additional period of up to 3 years, for a total period of admission of 6 years, and allows for dual intent.
