Adjustment of status is the process used to apply for lawful permanent residency status otherwise known as a green card. An application for adjustment of status can be completed while being physically present in the United States or if you are outside the U.S., you can apply to obtain your visa through consular processing.
There are a variety of ways to apply for a Green Card and eligibility varies depending on the category you are applying under. Applying for an adjustment of status can be pursued via family sponsorship, employer-based or qualifying investors. In the majority of cases someone else must file the petition for you (sponsorship/petitioner), and in some cases you may be able to file for yourself. If you currently need to apply for a waiver or hold a waiver you may be eligible to apply for adjustment of status despite past unlawful presence.
